Dorchester County probate filings are made with the Register of Wills for Dorchester County in Cambridge. The Orphans' Court for Dorchester County, which is the court under Md. Code, Est. & Trusts § 2-101, is also located at the courthouse at 206 High Street.
Dorchester County includes Cambridge, Church Creek, East New Market, Hurlock, Secretary, Taylors Island and Vienna. Venue for a Maryland estate is the county where the decedent was domiciled at death under Md. Code, Est. & Trusts § 5-103. If the decedent lived outside Maryland but owned Maryland property, venue is the Maryland county holding the largest part in value of the Maryland property, and only one county may maintain the proceeding under ET § 5-103(c)(1).
Probate in Dorchester County runs through two offices. You file with the Register of Wills for Dorchester County, an elected office under Md. Const. art. IV, § 41 that opens the estate, appoints the personal representative in administrative probate under ET § 5-301, and issues letters of administration under Md. Code, Est. & Trusts § 5-302. The Orphans' Court for Dorchester County is Maryland's probate court under ET § 2-101; it approves administration accounts under ET § 7-305, approves personal representative commissions under ET § 7-601 and attorney's fees, and hears contested matters. Most families deal only with the Register.
The jurisdiction process
- Start with the Dorchester Register of Wills, not the court. If there is an original will, the custodian delivers it to the Register for the county where administration should occur under Md. Code, Est. & Trusts § 4-203. If you need a court-office order only to search for assets or a safe-deposit-box will, ask about the limited order forms, Form 1147 and Form 1148.
- Choose the statewide Maryland opening packet. A small estate under Md. Code, Est. & Trusts § 5-601 uses Form 1103; a regular estate uses Form 1112; both commonly use Form 1104 for interested persons. If the proposed personal representative lives outside Maryland, add Form 1106 for appointment of a resident agent.
- File the paper packet with the Register of Wills for Dorchester County at the courthouse counter or by mail to P.O. Box 263, Cambridge, MD 21613. The Register's office states that filings cannot be accepted through email. Administrative probate under ET § 5-301 is the ordinary opening process before the Register.
- Expect the Register, not a judge, to handle ordinary appointment. In administrative probate, the Register may admit the will and appoint the personal representative under ET § 5-302. The authority document is letters of administration under ET § 5-302.
- Handle notice and publication. Dorchester's office publishes a local notice that, effective January 1, 2026, the Dorchester Star has new rates for publishing the Notice to Creditors, payable by check or money order to APG Chesapeake, and directs families to contact the office for current rates.
