Before you begin — know the assets and liabilities
Before you drive to Elkton, work out what the estate actually contains. Sunset searches for assets across more than 2,300 financial institutions, so you can see accounts, policies and debts before you choose a route instead of discovering later that the estate settlement packet should have been built differently.
Cecil County makes preparation especially important. The Register of Wills for Cecil County asks you to call before visiting so staff can tell you what documentation you will need, and the office cannot accept filings through email. If assets or a will may be locked behind an institution, ask about a Petition for Limited Orders, Form 1147, with Schedule C on Form 1148. The Registers list that limited order at $2.00 and describe it as an order permitting a search for assets in the decedent's name alone or for a will in a safe deposit box.
Which court handles jurisdiction
Cecil County estate filings go to one place: the Register of Wills for Cecil County in Suite 102 of the Circuit Courthouse at 129 East Main Street in Elkton. The same suite also serves the Orphans' Court for Cecil County, which is the court for decedent estates under Md. Code, Est. & Trusts § 2-101.
The Elkton office serves Cecilton, Charlestown, Chesapeake City, Elkton, North East, Perryville, Port Deposit, Rising Sun and the rest of Cecil County, including communities such as Childs, Colora, Conowingo, Earleville, Elk Mills, Georgetown, Perry Point and Warwick.
Venue is based on domicile, not convenience. A Maryland estate is opened in the county where the decedent was domiciled at the time of death, and probate proceedings may not be maintained in more than one county under Md. Code, Est. & Trusts § 5-103. If the decedent lived outside Maryland but owned Maryland property, venue is the county holding the largest part in value of that Maryland property. Cecil County borders Pennsylvania and Delaware, so being close to Elkton does not make an estate a Cecil County estate.
Probate in Cecil County runs through two offices. You file with the Register of Wills for Cecil County, an elected office under Md. Const. art. IV, § 41 that opens the estate, appoints the personal representative in administrative probate and issues letters of administration under Md. Code, Est. & Trusts §§ 5-301 and 5-302. The Orphans' Court for Cecil County is Maryland's probate court under ET § 2-101. It approves administration accounts, approves personal representative commissions under Md. Code, Est. & Trusts § 7-601 and approves attorney's fees, and hears contested matters. Most families deal only with the Register.
The jurisdiction process
- Confirm Cecil County is the right jurisdiction. The estate is opened where the decedent was domiciled at the time of death, and only one county may maintain the proceeding under Md. Code, Est. & Trusts § 5-103.
- Call the Register of Wills for Cecil County before you travel to Elkton. The office asks you to call before visiting so staff can tell you what documentation and information you need, and it strongly suggests making an appointment for in-person services.
- File the original will with the Register if one exists. The custodian of the will must deliver it to the Register for the county where administration should occur, promptly after death, under Md. Code, Est. & Trusts § 4-203(b)(1), even if no estate is opened.
- Identify assets, debts and whether more searching is needed. If you need authority to look for assets or for a will in a safe deposit box before opening the estate, ask about a Petition for Limited Orders, Form 1147, with Schedule C on Form 1148.
- Choose the correct Maryland statewide packet. Cecil County does not publish a local cover sheet or local probate forms. Use the statewide Register of Wills forms and download them to your device before completing them.
- Bring or mail the paper packet to the Register of Wills for Cecil County at 129 East Main Street, Suite 102, Elkton, Maryland 21921. The office cannot accept filings through email, and Maryland Electronic Courts does not cover Orphans' Court estate filings under Maryland Rule 20-101(w), Committee note.
- If the proposed personal representative lives outside Maryland, include Form 1106, Appointment of Resident Agent, signed by a Maryland resident who agrees to act as agent.
- If firearms may be part of the estate, review Form 1153, the affidavit about attempts to comply with federal, state and local firearms law. Do not bring firearms, ammunition, knives, scissors, box cutters, chemical sprays or other courthouse-prohibited items to the filing counter.
- The Register opens the estate in the ordinary uncontested case. In administrative probate, the Register admits the will, appoints the personal representative and issues letters of administration under Md. Code, Est. & Trusts §§ 5-301 and 5-302.
- Give notice as the statewide packet directs. Use the required notice forms and file the List of Interested Persons, Form 1104.
- Track the statewide deadlines. The inventory is due within 3 months of appointment under Md. Code, Est. & Trusts § 7-201, and administration accounts are due on the schedule in Md. Code, Est. & Trusts § 7-305. A claim against the estate is forever barred unless presented within the earlier of 6 months after the date of the decedent's death or 2 months after the personal representative mails the required notice under Md. Code, Est. & Trusts § 8-103(a).
- Pay the probate fee when the Register assesses it. Maryland's probate fee schedule is statewide under Md. Code, Est. & Trusts § 2-206(b)(2), for estates opened on or after October 1, 2022, and the Register assesses and collects it when the first administration account is filed under ET § 2-206(b)(5)(i), or when the final report is filed in modified administration under Md. Code, Est. & Trusts § 5-702 and ET § 2-206(b)(4).
- Ask about Form 1220 if the estate may qualify for the statutory fee waiver. The Register must waive fees under Md. Code, Est. & Trusts § 2-206(a)(4) when the statutory real-property and poverty conditions are met.
- If a contested matter or account approval requires court action, the Orphans' Court for Cecil County hears matters in the same courthouse. As of the Maryland Judiciary directory revised June 4, 2026, it sits every Tuesday at 9:00 a.m. until its list is completed, and Cecil County's three elected Orphans' Court judges sit together as a panel.
