Which court handles jurisdiction

File a Trego County probate case with the clerk of the district court at the Trego County Courthouse in WaKeeney. The 23rd Judicial District includes Gove, Trego, Rooks and Ellis counties (K.S.A. 4-224), but that district grouping does not move Trego County filings to another county. Each county has its own clerk of the district court (K.S.A. 20-343).

Kansas venue for probate or administration is governed by K.S.A. 59-2203. If a Kansas resident died owning real property in the county where the person lived, venue is that county. If the person did not own real property in the county of residence, venue may be the county of residence or any county where the person owned real property. For a nonresident, venue may be any Kansas county where estate property is to be administered. If proceedings begin in more than one county, the first-filed case controls while venue is determined, and the file is transferred if another county is proper.

The jurisdiction process

  1. Gather the death certificate, the will if there is one, asset information, debt information and real estate documents. If the decedent was a Kansas resident and left a will, decide quickly whether to petition to probate it, because a Kansas will cannot pass property unless a petition is filed within six months after death unless a statutory saving provision applies (K.S.A. 59-617).
  2. If the family is not ready to open an estate but needs to preserve a will, ask whether filing a will and affidavit under K.S.A. 59-618a fits. Kansas allows the will or a copy to be filed with the affidavit within six months under K.S.A. 59-617 so the will may remain available for later probate.
  3. Choose the right Kansas path. The small estates affidavit under K.S.A. 59-1507b can be used for qualifying personal property and is presented to the holder of the property, not opened as a court case. Other court paths include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250 after the required timing is met, informal administration under K.S.A. 59-3301, and simplified or supervised administration under K.S.A. 59-3202.
  4. Prepare the petition for the chosen court path. If you want simplified administration, ask for it in the petition and give the reasons, because the court decides at the hearing whether the estate will be simplified or supervised under K.S.A. 59-3202.
  5. Add the statewide case-filing cover sheet. If you are filing without a lawyer, also include the Self-Represented Litigant Certification Form. If you cannot afford the filing fee, ask about filing a Poverty Affidavit under K.S.A. 59-104.
  6. File with the Trego County clerk of the district court at 216 N Main Street in WaKeeney, by mail to the same address, by fax to 785-743-2726 or in the courthouse drop box. A probate estate filing is $131.50 as of August 2026 under K.S.A. 59-104. Attorneys file electronically under Rule 122 (Kan. Sup. Ct. R. 122).
  7. The court fixes the hearing on a petition for probate, administration or refusal to grant letters (K.S.A. 59-2222). Trego County also publishes a monthly motion day, with the civil docket beginning at 1:15 p.m.; ask the clerk for the current motion-day date before planning travel.
  8. Give the required notice. Hearing notice is published once a week for three consecutive weeks, and the mailing to heirs, devisees and legatees follows the timing and contents required by K.S.A. 59-2209. The petitioner also gives notice to creditors under K.S.A. 59-709.
  9. If there is a surviving spouse, make sure the required elective-share notice is handled within the Kansas probate timetable. Kansas requires that notice after qualification, after filing a refusal petition or after filing a will and affidavit, depending on the route.
  10. Attend the hearing or file a motion asking to appear by phone or video under Kan. Sup. Ct. R. 103. The court, not the clerk, admits the will and grants letters testamentary under K.S.A. 59-701 or letters of administration under K.S.A. 59-705 when the requirements are met.
  11. After letters are granted, file the inventory and valuation within 30 days unless the court allows more time (K.S.A. 59-1201). Track claims under the Kansas nonclaim statute, which bars demands unless they are presented within the later of four months from first publication or 30 days after actual notice to a known or reasonably ascertainable creditor (K.S.A. 59-2239).
  12. Pay allowed debts, expenses and taxes, distribute the estate under the court's authority, then seek final settlement and the court's final decree. When real estate is assigned by decree, the decree is used for the county transfer process required by Kansas law.
