Before you begin — know the assets and liabilities

Before you file in Mitchell County, list the assets, debts, account holders, real estate, vehicle titles, beneficiary designations, and the location of the will. Kansas procedure turns on what property is subject to probate, whether real estate is involved, whether letters are needed, and whether the will must be protected inside the six-month period under K.S.A. 59-617.

Sunset helps families start estate settlement by checking for accounts across 2,300 institutions, organizing assets and liabilities, and turning that information into a cleaner local filing plan. That preparation matters before you choose between a court case in Beloit and a non-court transfer option such as the small estates affidavit under K.S.A. 59-1507b.

Which court handles jurisdiction

Probate for Mitchell County is filed with the clerk of the district court at the Mitchell County Courthouse in Beloit (K.S.A. 20-343). Mitchell County is part of Kansas's 12th judicial district with Cloud, Jewell, Lincoln, Republic, and Washington counties (K.S.A. 4-213), but Mitchell County cases are filed at the Mitchell County courthouse, not at another county's courthouse.

Kansas venue for probate or administration depends on residence and real property. If the decedent lived in Kansas and owned real property in the county of residence, venue is that county. If the decedent lived in Kansas but did not own real property in the county of residence, venue may be the county of residence or any county where the decedent owned real property. If the decedent was not a Kansas resident, venue may be any county where estate property is left to be administered. A first-filed proceeding controls until venue is decided, and a case filed in the wrong county can be transferred (K.S.A. 59-2203).

The jurisdiction process

  1. Find the death certificate, the will, asset information, debts, real estate records, account statements, and beneficiary designations. If there is a will, decide quickly whether to petition for probate of the will in Mitchell County or at least file a will and affidavit under K.S.A. 59-618a, because a Kansas will generally cannot pass property unless a petition is filed within six months of death (K.S.A. 59-617).
  2. Choose the right Kansas path before preparing papers. A small estates affidavit under K.S.A. 59-1507b can be used for qualifying personal property, with the $75,000 figure effective July 1, 2023 under K.S.A. 59-1507b. Other paths include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, and simplified or supervised administration under K.S.A. 59-3202.
  3. Prepare the petition required for the chosen court path. If you want simplified administration under K.S.A. 59-3202, ask for it in the petition and give the reasons. Add the Kansas case-filing cover sheet and, if you are filing without a lawyer, the Self-Represented Litigant Certification Form.
  4. File with the clerk of the district court at the Mitchell County Courthouse in Beloit (K.S.A. 20-343). A self-represented filer may file in person, by mail, by fax to 785-738-4101, or by using the Mitchell County drop box. A drop box filing deposited by 4:00 p.m. local time counts as filed that day.
  5. Pay the filing charge or ask about a fee waiver. As of August 2026, a probate estate filing is $131.50 under K.S.A. 59-104, including the $109.50 fee and the $22 surcharge authorized through June 30, 2030. If you cannot afford the charge, ask about the Poverty Affidavit under K.S.A. 59-104.
  6. Wait for the court to set the hearing. Kansas requires the court to fix the time and place for a petition for probate of a will, administration, or refusal to grant letters (K.S.A. 59-2222).
  7. Give notice as ordered. When notice under K.S.A. 59-2209 is required, it is published once a week for three consecutive weeks, and the hearing date is set after that publication sequence. The notice to creditors must be handled under K.S.A. 59-709, and known or reasonably ascertainable creditors must receive actual notice before the nonclaim deadline under K.S.A. 59-2239.
  8. Attend the hearing or ask in advance to appear by phone or video under Kan. Sup. Ct. Rule 103. The judge decides whether a remote appearance is allowed, and the Kansas Judicial Council publishes a motion form for that request.
  9. If the court approves the petition, the court grants letters testamentary to an executor under K.S.A. 59-701 or letters of administration to an administrator under K.S.A. 59-705. The clerk is the filing office, but the court grants the authority.
  10. After letters are granted, file the inventory and valuation within 30 days unless the court allows more time (K.S.A. 59-1201). Then collect assets, handle claims, pay valid debts and taxes, keep records, and prepare for final settlement.
  11. Close through the court when the estate is ready. The usual closing path is a petition for final settlement and accounting, followed by the court's final decree assigning the estate (K.S.A. 59-2247, K.S.A. 59-2249).
