Which court handles jurisdiction

Meade County probate filings go to the clerk of the district court under K.S.A. 20-343 at the Meade County Courthouse in Meade. The court sits in Kansas's 16th Judicial District (K.S.A. 4-217), which also includes Gray, Ford, Kiowa, Clark and Comanche counties, but a Meade County estate is filed at the Meade County filing office.

Venue in Kansas depends on K.S.A. 59-2203. If the decedent was a Kansas resident and owned real property in the county of residence, file there. If the resident decedent owned no real property in the county of residence, the filing can be in the county of residence or in any county where the decedent owned real property. For a nonresident decedent, the filing can be in any Kansas county where estate property is to be administered. If proceedings start in more than one county, the first-filed proceeding controls while venue is decided, and a misfiled case is transferred to the proper county.

The jurisdiction process

  1. Locate the death certificate, the original will if it can be found, and any copy of the will. If there is a will, decide quickly whether to petition for probate of the will in Meade County or at least preserve the will within six months under K.S.A. 59-617 by filing a will or copy with an affidavit under K.S.A. 59-618a.
  2. Choose the filing path before drafting. Kansas options include the small estates affidavit for personal property under K.S.A. 59-1507b, refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, and simplified administration or supervised administration as the court determines under K.S.A. 59-3202. If you want simplified administration, ask for it in the petition and state the reasons.
  3. Prepare the petition using the statutory requirements for the path you are requesting. A new case also needs the statewide case-filing cover sheet, and a person filing without a lawyer needs the Self-Represented Litigant Certification Form.
  4. File with the Meade County clerk of the district court under K.S.A. 20-343 at 200 N Fowler St., by mail to PO Box 623, by fax to 620-873-8759, or in the courthouse drop box. A drop-box filing deposited by 4:00 p.m. local time counts as filed that day. Pay the $131.50 filing charge as of July 1, 2026 through June 30, 2030 under K.S.A. 59-104, or file a Poverty Affidavit under K.S.A. 59-104 if you are asking the court to waive all or part of the charge.
  5. The court fixes the hearing after the petition is filed (K.S.A. 59-2222). If phone or video participation is needed, file the Kansas Judicial Council motion and ask under Kan. Sup. Ct. R. 103; the judge decides whether to allow it.
  6. Give required notice. Hearing notice is published once a week for three consecutive weeks under K.S.A. 59-2209, mailed with the petition and will as required by that statute, and timed so the hearing falls within the statutory window. Notice to creditors is handled under K.S.A. 59-709.
  7. If there is a surviving spouse, send the required elective-share notice when Kansas law requires it. This is separate from ordinary hearing notice.
  8. Attend the hearing or appear by any method the judge allows under Kan. Sup. Ct. R. 103. The court, not the clerk, admits the will and grants letters testamentary to an executor under K.S.A. 59-701 or letters of administration to an administrator under K.S.A. 59-705.
  9. After letters are granted, file the inventory and valuation within 30 days under K.S.A. 59-1201 unless the court gives a different deadline. Publish and mail creditor notices as required, and track claims under K.S.A. 59-2239.
  10. Collect assets, pay valid debts, pay taxes owed by the estate, and distribute only as the court process allows. To close, file the petition for final settlement and accounting, then obtain the court's final decree assigning the estate.
