Which court handles jurisdiction
Probate for Hamilton County is filed with the clerk of the district court at the Hamilton County Courthouse in Syracuse. Kansas law requires a clerk of the district court in each county, so the 25th Judicial District (K.S.A. 4-226) does not move Hamilton County filings to another county (K.S.A. 20-343).
Venue is governed by K.S.A. 59-2203. If the decedent was a Kansas resident and owned real property in the county of residence, filing belongs in that county. If the decedent did not own real property in the county of residence, filing may be in the county of residence or in any Kansas county where the decedent owned real property. If the decedent was not a Kansas resident, filing may be in a Kansas county where estate property must be administered. If competing cases are started, the first-filed proceeding controls while venue is resolved, and the file is transferred if another county is proper.
The jurisdiction process
- Find the death certificate, the will if there is one, asset information, debt information, and any real estate documents before filing in Syracuse.
- Protect the will deadline first. A will of a Kansas resident cannot pass property unless a petition for probate is filed within six months of death, unless a savings provision applies (K.S.A. 59-617). If the family is not ready to open a full estate, ask about filing a will and affidavit under K.S.A. 59-618a.
- Choose the Kansas path before preparing papers. The small estates affidavit under K.S.A. 59-1507b is presented to the property holder and is not filed as a Hamilton County court case. - Add the statewide case-filing cover sheet. If you are filing without a lawyer, also include the Self-Represented Litigant Certification Form.
- File with the clerk of the district court in Syracuse, not in another 25th Judicial District county (K.S.A. 20-343; K.S.A. 4-226). You may file at the counter, by mail to P.O. - Pay the $131.50 probate estate filing fee, effective July 1, 2026 through June 30, 2030, or file a Poverty Affidavit if you are asking the court to waive or defer the fee (K.S.A. 59-104).
- The court fixes the hearing date and place after the petition is filed (K.S.A. 59-2222). For short hearings, the 25th district uses county motion-day calendars outside Finney County, and the Hamilton County clerk's office keeps the Syracuse calendar.
- Give notice as ordered. Hearing notice is published once a week for three consecutive weeks, with mailing to heirs, devisees and legatees within seven days after first publication when K.S.A. 59-2209 applies. Notice to creditors is also published within the statutory time for a petition for administration or probate of a will (K.S.A. 59-709).
- Ask early if you need remote appearance. Remote appearance is discretionary under Rule 103 (Kan. Sup. Ct. R. 103), and the Kansas Judicial Council publishes a motion form for asking to appear by phone or video.
- Attend the hearing. If the court grants the petition, the court admits the will and grants letters testamentary to the executor under K.S.A. 59-701, or grants letters of administration to an administrator under K.S.A. 59-705.
- After letters are granted, file the inventory and valuation within 30 days unless the court allows more time (K.S.A. 59-1201). Handle creditor claims under the later-of rule in K.S.A. 59-2239, including the four months from first publication component and the 30 days after actual notice component for known or reasonably ascertainable creditors.
- Pay allowed debts, expenses and taxes, then close with a petition for final settlement and a final decree assigning the estate. If real estate is assigned, the decree is entered on the county clerk's transfer record under K.S.A. 59-2249.
