Before you begin — know the assets and liabilities
Before you file in Edwards County, list the assets, debts, account owners, beneficiary designations, real estate and any will. That determines whether the matter needs court administration in Kinsley, a Kansas Judicial Council small estates affidavit under K.S.A. 59-1507b for personal property, or another Kansas route.
Sunset's estate settlement tools help families identify accounts across more than 2,300 institutions, organize liabilities and prepare for the filing path that fits the estate. That early inventory also helps you avoid missing the K.S.A. 59-617 six month will deadline.
Which court handles jurisdiction
Probate for Edwards County is filed with the clerk of the district court under K.S.A. 20-343 at the Edwards County Courthouse in Kinsley. Edwards County is part of Kansas's 24th judicial district with Hodgeman, Lane, Ness, Pawnee and Rush counties under K.S.A. 4-225, but an Edwards County case is filed at the Edwards County courthouse, not at another county's filing counter.
Venue in Kansas depends on the decedent's residence and real property under K.S.A. 59-2203. If a Kansas resident owned real property in the county of residence, proceedings are filed there. If the resident did not own real property in the county of residence, the filing may be in the county of residence or any county where the decedent owned real property. For a nonresident, proceedings may be filed in any Kansas county where estate property is to be administered. If proceedings are started in more than one county, the first-filed case controls while venue is resolved, and a misfiled case is transferred rather than dismissed.
The jurisdiction process
- Gather the death certificate, the will if there is one, account information, debts and real estate records. If the decedent was a Kansas resident and left a will, decide quickly whether to petition for probate of the will or at least preserve it by filing a will and affidavit under K.S.A. 59-618a, because the will generally cannot pass property unless a petition is filed within six months after death under K.S.A. 59-617.
- Choose the Kansas path before preparing papers. The small estates affidavit under K.S.A. 59-1507b is for qualifying personal property and is presented to the holder of the property, not filed as a court case. Court routes include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, and simplified or supervised administration under K.S.A. 59-3202.
- Draft the petition required by Kansas law. A petition for administration uses K.S.A. 59-2219, and a petition to probate a will uses K.S.A. 59-2220. If you want simplified administration, ask for it in the petition and give the reasons, because the court decides under K.S.A. 59-3202.
- Add the required filing documents. A new self-represented case needs the Kansas Judicial Council case-filing cover sheet and the Self-Represented Litigant Certification Form. If you cannot afford the filing total, use the Poverty Affidavit process tied to K.S.A. 59-104.
- File with the Edwards County clerk of the district court under K.S.A. 20-343 at 312 Massachusetts, PO Box 232, Kinsley, KS 67547. A self-represented filer may file in person, by mail, by fax to 620-659-2998, or in the drop box. A drop-box filing made by 4:00 p.m. Central Time counts that day. As of August 2026, the probate estate filing total is $131.50 under K.S.A. 59-104.
- The court fixes the hearing under K.S.A. 59-2222. Notice is published once a week for three consecutive weeks, with mailing to heirs, devisees and legatees as required by K.S.A. 59-2209. Notice to creditors is also published within 30 days after filing under K.S.A. 59-709.
- If there is a surviving spouse, send the required elective-share notice within 10 days when K.S.A. 59-2233 applies. Known or reasonably ascertainable creditors must receive actual notice, and claims are governed by the later of four months from first publication or 30 days after actual notice under K.S.A. 59-2239.
- Attend the hearing or ask in advance for a phone or video appearance under Kansas Supreme Court Rule 103 (Kan. Sup. Ct. R. 103). If the court admits the will, the court grants letters testamentary under K.S.A. 59-701. If there is no will and administration is needed, the court grants letters of administration under K.S.A. 59-705.
- After letters are granted, administer the estate. File the inventory and valuation within 30 days after letters under K.S.A. 59-1201, collect assets, address creditor claims, pay taxes and expenses, and keep records for the final settlement.
- Close the estate through the petition for final settlement and accounting, then obtain the court's final decree assigning the estate under K.S.A. 59-2247 and K.S.A. 59-2249. If real estate is involved, the decree may need to be reflected in the county clerk's transfer record as directed by K.S.A. 59-2249.

Sup. Ct. R. 103).

Scenarios
| Situation | Likely Edwards County path | Where Sunset helps |
|---|---|---|
| Surviving spouse with co-owned home | Start by checking how the deed is titled. A termination of joint tenancy has a $70.50 filing total under K.S.A. 59-104 as of August 2026, and a probate estate may still be needed for assets in the decedent's name alone. Kansas also has a homestead allowance under K.S.A. 59-6a215 and elective-share notice duties. | Sunset helps identify accounts, debts and title clues so the spouse can see what passes outside probate and what may need an Edwards County filing. |
| Out-of-state adult child with a small estate | If the probate assets qualify and there is no real estate to transfer, the small estates affidavit under K.S.A. 59-1507b may handle personal property up to $75,000, effective July 1, 2023. If letters are needed, a nonresident personal representative can serve after appointing a Kansas resident agent under K.S.A. 59-1706 and may ask for a remote appearance under Kansas Supreme Court Rule 103 (Kan. Sup. Ct. R. 103). | Sunset organizes the asset list and can help generate the right packet for the Kinsley filing or identify when a lawyer should prepare the petition. |
| Parent settling predeceased child's estate, home must be sold | The small estates affidavit under K.S.A. 59-1507b does not transfer a house. The parent should consider whether refusal to grant letters under K.S.A. 59-2287, informal administration under K.S.A. 59-3301, or simplified administration under K.S.A. 59-3202 fits, while protecting any will within the K.S.A. 59-617 six month period. | Sunset helps build the asset picture, prepare estate settlement paperwork and connect the family with a Kansas probate attorney for the real estate sale questions. |

When to hire an attorney
Counsel makes sense when an Edwards County estate includes real estate to sell, a contested will, unclear heirs, creditor problems, a nonresident fiduciary who must appoint a Kansas resident agent under K.S.A. 59-1706, or a missed K.S.A. 59-617 will deadline. A lawyer can draft the petition, handle notice, prepare real estate sale papers and guide the final settlement. Sunset connects to a vetted attorney.

Can I look up an Edwards County probate case online?
Use Kansas Courts CaseSearch for public district court case information. Edwards County joined Kansas eCourt on September 12, 2022, so online documents depend on that date and the public-access rules for the case.
Does Edwards County have local probate forms?
Edwards County does not publish a local probate packet on its public court page. Kansas Judicial Council statewide forms are still important, including the small estates affidavit under K.S.A. 59-1507b, the case-filing cover sheet and the Self-Represented Litigant Certification Form.
Can I appear by phone or video for an Edwards County probate hearing?
You may ask. A phone or video appearance is discretionary under Kansas Supreme Court Rule 103 (Kan. Sup. Ct. R. 103), and the judge can deny the request. Use the Kansas Judicial Council motion form and ask the Edwards County clerk how the 24th district handles the request.
How fast will Edwards County set a probate hearing?
No Edwards County probate hearing day or expected wait is posted on the public court page. Kansas law says the court fixes the hearing under K.S.A. 59-2222, and published hearing notice follows the timing in K.S.A. 59-2209.
What happens if I wait too long to file a Kansas will in Edwards County?
For a Kansas resident's will, K.S.A. 59-617 generally requires a petition for probate within six months after death for the will to pass property. If you are not ready to open an estate, ask quickly about filing a will and affidavit under K.S.A. 59-618a to preserve the will.
