Before you begin — know the assets and liabilities

Before you choose a filing path in Coventry, make a working list of the decedent's assets, debts, likely heirs, and any will. The fee you pay at Coventry Town Hall starts with your own estimate of personal property, and the probate court later recalculates that amount when the inventory is filed under R.I. Gen. Laws 33-9-1 and 33-22-21.

Sunset can help with the first estate settlement step by searching across more than 2,300 institutions for accounts and assets, then organizing what you find into a probate packet for the Coventry Probate Court.

Which court handles jurisdiction

File where the decedent lived. If the decedent's home was in Coventry, the Coventry Probate Court is the court, and no other Rhode Island probate court has jurisdiction over the estate (R.I. Gen. Laws 8-9-9). If the decedent lived in a neighboring city or town, that municipality's own probate court is the one to file in.

Rhode Island has no county probate courts and no county government. The Coventry Probate Court is the court for the town of Coventry and for no other municipality (R.I. Gen. Laws 8-9-9). Coventry is in Kent County, which matters in one respect only: an appeal from a decree of this court goes to the Superior Court for that county (R.I. Gen. Laws 33-23-1), and the Superior Court sits in four divisions statewide, one of which is the Kent County division.

The jurisdiction process

  1. Work out what the decedent owned and owed. The estimate on the petition drives the state fee under R.I. Gen. Laws 33-22-21, and it also shapes which Coventry filing path fits the estate settlement.
  2. Download the statewide PC forms from the live Secretary of State probate forms catalogue. Coventry rule 17 makes statewide forms mandatory, and probate forms are furnished without charge under R.I. Gen. Laws 33-22-16.
  3. File in person or by mail with the Probate Clerk's office at Coventry Town Hall, 1670 Flat River Road, Coventry, RI 02816. The town clerk is the clerk of the probate court under R.I. Gen. Laws 8-9-6.
  4. Pay before the petition is filed. Rhode Island charges one percent of personal property with a $30 minimum and a $1,500 maximum, figures unchanged since at least 1996, based on estimates submitted by the petitioner and later revised if needed (R.I. Gen. Laws 33-22-21). Coventry's fee schedule accessed September 1, 2026 lists $84.00 on waiver and $134.00 with advertisement for an opening will or administration petition.
  5. Decide whether the matter can proceed on waiver under R.I. Gen. Laws 33-22. Coventry's local schedule shows a $50.00 savings on a will or administration petition filed on waiver rather than with advertisement under R.I. Gen. Laws 33-22-11, and Coventry's rule requires waiver matters to be filed at least 24 hours before the hearing.
  6. If advertisement is required under R.I. Gen. Laws 33-22-11, meet Coventry's local deadline. Matters requiring publication must be filed, with fees paid, no later than the Monday of the week of publication, and Coventry's rules identify publication in The Kent County Daily Times.
  7. On the hearing day, sign the docket in the Town Clerk's Office. Coventry rule 2 says cases are heard in sign-in order and contested matters are heard last, consistent with R.I. Gen. Laws 33-22-30.
  8. Attend the session at 3:00 p.m. on the second or fourth Thursday of the month in the Town Hall Council Chambers. Coventry publishes a current 2026 hearing-date spreadsheet, and local administrative rules must state session dates and times under R.I. Gen. Laws 33-22-29.
  9. After appointment, order certificates of appointment from the probate clerk. Each certificate of appointment costs $5, a statutory amount under R.I. Gen. Laws 33-22-21, and banks, transfer agents, and agencies commonly ask for separate originals.
  10. File the inventory within 90 days of appointment unless the court allows more time. Coventry's local fee schedule accessed September 1, 2026 lists the inventory at one percent of personal property, with a $34.00 minimum and a $1,504.00 maximum, and the statewide inventory deadline is R.I. Gen. Laws 33-9-1.
  11. Resolve the Rhode Island estate tax position before closing. The Coventry Probate Court cannot allow the final account unless the tax has been paid, extended, or determined not to apply, and the Division of Taxation's certification settles that point (R.I. Gen. Laws 44-23-36).
  12. Close with the required account or affidavit. Coventry's rules require an attorney certification or supporting documents with an accounting, and an affidavit of complete administration requires original releases, the paid funeral bill, estate-tax lien discharge, claim releases, and creditor-notice proof under the local rules and R.I. Gen. Laws 33-11-5.1, 33-14-2.2, and 44-23-36.

Executor duties

Coventry's published rules add several local gates to the ordinary duties of a personal representative. An accounting will not be accepted unless it includes the attorney certification described in R.I. Gen. Laws 33-14-2.2 or copies of canceled checks and documents supporting the entries. Coventry also requires the fiduciary's affidavit of notice to known and easily ascertainable creditors before a first and final accounting or affidavit of complete administration is accepted, tying local closing practice to R.I. Gen. Laws 33-11-5.1.

Coventry rule 14 says inventories by administrators and executors are strictly enforced and are due within 90 days unless the court allows an extension on petition (R.I. Gen. Laws 33-9-1). Coventry rule 15 also requires original releases, the paid funeral bill, estate-tax lien discharge, claim releases, and creditor-notice certification before an affidavit of complete administration will be accepted.

Forms and documents

Probate forms at the Coventry Probate Court

Rhode Island probate forms are statewide. A legislative commission prescribes them and the Secretary of State publishes them free to the public, to lawyers and to the probate clerks (R.I. Gen. Laws 33-22-16); they are numbered in the PC series and downloadable at https://www.sos.ri.gov/divisions/business-services/probate-forms/. The Coventry Probate Court uses the same forms as every other Rhode Island probate court, and Coventry rule 17 makes the statewide forms mandatory.

Coventry's probate page points readers to an older Secretary of State path that redirects away from the probate form catalogue, so use the live Secretary of State probate forms page instead. Coventry does not publish a separate downloadable probate form of its own, although its local rules say attorney and fiduciary fee-affidavit forms are on file in the Probate Clerk's office.

Fees

Rhode Island sets probate fees by statute and the same state schedule applies in all 39 cities and towns. For a petition to probate a will or to grant administration, the fee is one percent of the decedent's personal property over which the court has jurisdiction, with a floor of $30 and a ceiling of $1,500, figures unchanged since at least 1996 (R.I. Gen. Laws 33-22-21). Two things about that fee surprise people. First, it is due before the petition is filed and it is calculated from an estimate you supply on the petition itself, so the amount you pay at the counter is provisional: the statute requires the fee to be revised when the estimate turns out to be wrong, with a further payment or a refund, and the Coventry Probate Court recalculates it against the inventory you file within 90 days of your appointment (R.I. Gen. Laws 33-9-1). Second, the statutory fee is not the whole cost. Most petitions have to be advertised in a newspaper for two weeks, and the cost of that advertising is paid to the clerk in advance (R.I. Gen. Laws 33-22-11); Coventry also charges its own records fee. If every interested party signs a waiver under R.I. Gen. Laws 33-22, the advertising requirement and its cost can fall away. A separate $30 fee, unchanged since at least 1996, applies to a list of other petitions, including filing a will with no probate, an affidavit of complete administration and a petition to file a claim out of time (R.I. Gen. Laws 33-11-5 and 33-22-21), and each certificate of appointment costs $5 under R.I. Gen. Laws 33-22-21. Copies of anything on file are $1.50 a page with a $3 charge to certify, figures set by R.I. Gen. Laws 33-22-21.

Timeline

  1. Before filing, check whether the petition needs advertisement under R.I. Gen. Laws 33-22-11 or can proceed on waiver under R.I. Gen. Laws 33-22.
  2. For an advertised matter, Coventry rule 4 requires the filing and fees to be in the Probate Clerk's office no later than the Monday of the week of publication. The rule states that publication runs in the Wednesday edition of The Kent County Daily Times under R.I. Gen. Laws 33-22-11.
  3. For a matter on waiver under R.I. Gen. Laws 33-22, Coventry rule 4 requires filing at least 24 hours before the hearing.
  4. Sessions are held at 3:00 p.m. on the second and fourth Thursday of each month in the Town Hall Council Chambers, as published in Coventry's local administrative rules under R.I. Gen. Laws 33-22-29 and its 2026 hearing-date spreadsheet.
  5. On the hearing day, sign the docket in the Town Clerk's Office. Coventry rule 2 says cases are heard in sign-in order and contested matters are heard last, consistent with R.I. Gen. Laws 33-22-30.
  6. After appointment, file the inventory within 90 days unless the court allows more time, and expect Coventry's one percent inventory charge to be reconciled against the opening estimate (R.I. Gen. Laws 33-9-1 and 33-22-21).

Local nuance

Coventry-specific considerations

Local pointWhy it matters
Published local rulesCoventry publishes 19 local administrative rules under R.I. Gen. Laws 33-22-29, updated January 1, 2020. They cover hearing order, filing cutoffs, recordings, creditor notice, inventories, attorney and fiduciary fee affidavits, and closing documents.
Town solicitor fallbackCoventry rule 19 says that under Article VI, Section 6.04 of the town charter, the town solicitor performs the probate judge's duties if the probate judge is absent, disabled, disqualified, or the office is vacant. Rhode Island probate judge authority is governed by R.I. Gen. Laws 8-9-4 and 8-9-2.1.
Summer schedule conflictCoventry's rules say summer sessions are held only on the fourth Thursday in June, July, and August, but the town's 2026 hearing-date spreadsheet lists second and fourth Thursday sessions in those months. Use the current calendar and call the clerk before relying on the older summer language.
Administrative handlingCoventry rule 15 says affidavits of complete administration and voluntary informal filings under R.I. Gen. Laws 33-24 are handled administratively in the Probate Clerk's office and do not appear on the docket under R.I. Gen. Laws 33-22-30.
Sale fee distinctionCoventry's fee schedule accessed September 1, 2026 lists $50.00 for a sale of real estate and $0.00 for a sale of personal estate. The statewide petition process and any court authority still matter even where the local charge is $0.00.

Small-estate Alternatives

The voluntary informal route under R.I. Gen. Laws 33-24 is statewide, but Coventry adds two local details. Coventry's fee schedule accessed September 1, 2026 lists voluntary informal administration under R.I. Gen. Laws 33-24 at $39.00 and voluntary informal executor under R.I. Gen. Laws 33-24-2 at $39.00. Coventry rule 15 says these filings are handled administratively in the Probate Clerk's office and do not appear on the court docket under R.I. Gen. Laws 33-22-30.

The statewide limits still control: for the voluntary informal administration route, the estate must consist entirely of personal property, the qualifying amount is $15,000 in force since 2005 exclusive of tangible personal property, and the filer under R.I. Gen. Laws 33-24-1 must be a Rhode Island resident. A named out-of-state executor under a will may use the voluntary informal executor route only by appointing a resident agent under R.I. Gen. Laws 33-24-2.

2026 hearing datesCoventry publishes a 2026 Probate Court Hearing Dates spreadsheet listing second and fourth Thursday sessions through most of the year, with only one November session listed.
Current calendar versus older rule textThe 2026 spreadsheet does not follow the older rules document's summer-only fourth Thursday language, so families should use the current calendar and call the clerk before relying on the older summer clause.

Scenarios

SituationLikely Coventry pathWhere Sunset helps
Surviving spouse with a co-owned homeStart by confirming what is probate property and what passed outside probate. If a Coventry filing is needed, filing on waiver under R.I. Gen. Laws 33-22 can reduce Coventry's opening will or administration charge from $134.00 with advertisement under R.I. Gen. Laws 33-22-11 to $84.00 on Coventry's fee schedule accessed September 1, 2026. A certificate of appointment costs $5 under R.I. Gen. Laws 33-22-21.Sunset helps separate jointly held assets from assets requiring court authority, then organizes the estate settlement packet for the Coventry Probate Court.
Out-of-state adult child with a small estateIf a parent died intestate, an out-of-state child cannot serve as voluntary administrator under R.I. Gen. Laws 33-24-1 because that route requires the filer to be a Rhode Island resident. If the child is named executor in a will, R.I. Gen. Laws 33-24-2 allows the voluntary executor route with a resident agent, using PC-3.5 under R.I. Gen. Laws 33-24-2. Coventry lists each voluntary informal route at $39.00 on its fee schedule accessed September 1, 2026.Sunset helps a New York, Florida, California, or Texas child identify whether a will exists, list accounts, and decide whether Coventry's voluntary informal route under R.I. Gen. Laws 33-24 fits.
Parent settling a predeceased child's estate when a home must be soldA house means the voluntary informal route under R.I. Gen. Laws 33-24 will not fit. The personal representative may need authority to sell real estate, and Coventry's fee schedule accessed September 1, 2026 lists sale of real estate at $50.00. Before the final account can be allowed, the Rhode Island estate tax position must be resolved under R.I. Gen. Laws 44-23-36.Sunset helps locate accounts, build the inventory under R.I. Gen. Laws 33-9-1, prepare the court packet, and connect the family with a local probate attorney when a sale or tax lien is involved.

Frequently asked questions

Where do I file probate if the person lived in Coventry?

File with the Probate Clerk's office at Coventry Town Hall, 1670 Flat River Road, Coventry, RI 02816. The Coventry Probate Court is the court for the town of Coventry alone under R.I. Gen. Laws 8-9-9, and the town clerk is the clerk of the probate court under R.I. Gen. Laws 8-9-6.

When does the Coventry Probate Court meet?

Coventry sessions are at 3:00 p.m. on the second and fourth Thursday of each month in the Town Hall Council Chambers. Coventry's local administrative rules publish the session schedule under R.I. Gen. Laws 33-22-29, and the town's 2026 hearing-date spreadsheet should be checked before you plan travel.

Can I file a Coventry probate case electronically?

Coventry's website does not offer electronic filing for probate. Plan on paper filing with the town clerk under R.I. Gen. Laws 8-9-6; the Rhode Island statutes require a written signed petition and payment before filing, with a written receipt from the clerk (R.I. Gen. Laws 33-22-1 and 33-22-21).

How much does probate cost in Coventry?

The state fee is one percent of personal property, with a $30 minimum and a $1,500 maximum, figures unchanged since at least 1996, and it is based on estimates submitted before filing and later revised if needed (R.I. Gen. Laws 33-22-21). Coventry's fee schedule accessed September 1, 2026 lists an opening will or administration petition at $84.00 on waiver under R.I. Gen. Laws 33-22 and $134.00 with advertisement under R.I. Gen. Laws 33-22-11.

Does Coventry have its own probate forms?

Coventry uses Rhode Island's statewide probate forms, and Coventry rule 17 makes the statewide forms mandatory. The Secretary of State publishes the PC forms free to the public under R.I. Gen. Laws 33-22-16 at https://www.sos.ri.gov/divisions/business-services/probate-forms/.

Is there an online Coventry probate case search?

Coventry's own probate page does not publish an online probate case search. Probate records are kept by the town clerk under R.I. Gen. Laws 8-9-7, and the state Judiciary's portal does not index municipal probate courts.

Do I have to travel to Coventry for the hearing?

Coventry does not publish a local remote appearance option. If every interested party signs the required waiver under R.I. Gen. Laws 33-22, the matter may be simpler and less expensive, but you should call the probate clerk before assuming a hearing can be avoided.

What happens after I am appointed in Coventry?

Ask the probate clerk for certificates of appointment, which cost $5 each under R.I. Gen. Laws 33-22-21. Then file the inventory within 90 days unless the court allows more time (R.I. Gen. Laws 33-9-1), handle creditor notice under R.I. Gen. Laws 33-11-5.1, and resolve the estate tax position before the final account is allowed under R.I. Gen. Laws 44-23-36.

Can an out-of-state child use the voluntary informal route in Coventry?

Not for an intestate estate under R.I. Gen. Laws 33-24-1, because that voluntary administrator must be a Rhode Island resident. A named executor in a will may use the voluntary informal executor route under R.I. Gen. Laws 33-24-2 if the original will is filed and the out-of-state executor appoints a resident agent using PC-3.5 under R.I. Gen. Laws 33-24-2.
