In informal probate, the court reviews the application, makes the required findings, issues the written statement of informal probate, and appoints the personal representative when the statutory requirements are met (N.D.C.C. §§ 30.1-14-02, 30.1-14-03, 30.1-14-07).
  6. Receive authority to act. When there is a will, the authority document is letters testamentary. When there is no will, it is letters of administration. In informal proceedings, the court must issue letters within ten working days after all requirements for informal proceedings have been met (N.D.C.C. § 30.1-14-07).
  7. Address notice, creditors and administration. A personal representative may publish notice to creditors, which changes the claim period, and must handle creditor claims under the North Dakota creditor statutes (N.D.C.C. §§ 30.1-19-01, 30.1-19-03). Prepare the inventory and appraisement on the statewide schedule (N.D.C.C. § 30.1-18-06).
  8. Use hearings and remote appearance only when they apply. Informal probate under N.D.C.C. ch. 30.1-14 is designed to proceed without a court appearance when the proper forms and procedures are used. Formal probate under N.D.C.C. ch. 30.1-15 involves hearings. A party who wants a proceeding held by reliable electronic means must use the motion procedure in N.D. Sup. Ct. Admin. R. 52.
  9. Administer and close the estate. After assets are collected, debts and claims are addressed, and distributions are ready, follow the North Dakota closing process for the estate (N.D.C.C. ch. 30.1-21). If certified copies are needed, the statewide charge is $20, effective July 1, 2025, with additional copies of the same document at $10, effective July 1, 2025 (N.D.C.C. § 27-05.2-03).
