The jurisdiction process
- Gather the death certificate, the original will if there is one, a list of heirs and beneficiaries, and a first inventory of accounts, vehicles, real property, debts and tax issues.

- After letters are granted, make reasonably diligent efforts to identify creditors, mail notice to known creditors, file the diligent-search affidavit, and only then publish the notice to creditors for three consecutive weeks (Miss. Code Ann. § 91-7-145).
- Creditors probate and register claims with the clerk. Claims not registered within 90 days after the first publication are barred (Miss. Code Ann. § 91-7-151).
- Administer the estate: collect assets, preserve property, address debts and taxes, keep records and file any required annual accountings while the estate remains open.
- Close by accounting to the chancery court, obtaining the final decree of distribution and discharge, and making the court-approved distributions.
Executor duties
Madison County adds several local paperwork and conduct points to the statewide duties of an executor, administrator or other fiduciary under Uniform Chancery Court Rule 6.02. The county's certificate of fiduciary is sworn before a notary and applies to a decedent's estate as well as to other fiduciary matters.
