Before you begin — know the assets and liabilities

Before you file anything in Wayne County, list the assets, debts, possible nonprobate transfers and whether the decedent owned real estate in Wayne County. Estate settlement is much easier when you know whether the family needs full administration, a small estate affidavit, refusal of letters or another Missouri path.

Sunset's 2,300-institution asset discovery can help locate accounts, insurance, investment assets and debts before you decide what to file at the Greenville courthouse.

Which court handles jurisdiction

The Probate Division of the Circuit Court of Wayne County serves estates venued in Wayne County from the courthouse in Greenville. The 42nd Judicial Circuit also includes Crawford, Dent, Iron and Reynolds counties, but each county keeps its own courthouse and probate filing counter.

Missouri venue is based first on the county where the decedent was domiciled. A will is probated and letters are granted in the county where the deceased person's domicile was located, and later estate proceedings stay in the county where letters were granted (RSMo 473.010).

The jurisdiction process

  1. Identify the correct court. For a Wayne County resident, use the Probate Division of the Circuit Court of Wayne County at 109 Walnut St. in Greenville, unless Missouri's nonresident property venue rule points somewhere else (RSMo 473.010).
  2. Choose the Missouri path before preparing forms. Full administration appoints a personal representative. A small estate affidavit (RSMo 473.097) and refusal of letters (RSMo 473.090) do not appoint a personal representative.
  3. Use statewide Missouri probate forms and any current instructions from the clerk. Wayne County does not publish a county-specific probate packet or cover sheet on its Judiciary page.
  4. File with the clerk of the probate division. In Wayne County, that is the Circuit Clerk's counter at the courthouse, mailing address P.O. Box 78, Greenville, MO 63944. Deliver any original will to the probate division on paper.
  5. Pay the court cost collected by the Wayne County clerk. If original letters are requested, the statewide component starts at $115 under Court Operating Rule 21.01, effective September 1, 2023, and later inventory-value charges can apply up to the $565 cap under Court Operating Rule 21.01, effective September 1, 2023.
  6. Handle notice. When letters testamentary or letters of administration issue, the clerk causes notice of appointment and notice to creditors to be published once a week for four consecutive weeks (RSMo 473.033).
  7. Attend any hearing the court sets. No Wayne County probate remote-appearance rule is posted, so ask the clerk before planning to appear by phone or video.
  8. Use the authority document after appointment. With a will, the authority document is letters testamentary. Without a will, it is letters of administration. A nonlawyer personal representative cannot appear in court except through an attorney, although a personal representative may prepare and file their own inventories and settlements (RSMo 473.153.7).
  9. Administer and close the estate. The personal representative files the inventory within 30 days after letters are granted unless the court allows more time (RSMo 473.233), manages creditor deadlines under Missouri law, distributes property and completes the final estate settlement steps required for the chosen administration path.

Forms and documents

Probate forms in Wayne County

Wayne County does not publish a county-specific probate packet, checklist or cover sheet on the Missouri Judiciary's Wayne County page. Use the statewide Missouri probate forms page and call the Wayne County clerk before filing if you are unsure whether the 42nd Judicial Circuit requires a local cover sheet or local formatting.

For full administration, remember the Missouri attorney rule. A nonlawyer personal representative cannot appear in court except through an attorney (RSMo 473.153.7). Small estate affidavit and refusal of letters filings are different because those paths do not appoint a personal representative.
