The jurisdiction process

- Publish the creditor notice once each week for three successive weeks in a newspaper published in the county where the estate is administered, then file proof of publication. The claims date must be at least six months from first publication or three months from mailing, whichever is later (755 ILCS 5/18-3).
- Prepare the inventory, manage assets, pay valid claims and keep the estate accounting. Under Eighth Judicial Circuit Rule 8.3, an independent representative in independent administration under Article XXVIII does not have to file the inventory with the court, but the inventory still must be prepared.
- Close the estate after administration is complete. Eighth Judicial Circuit Rule 8.9 governs final and binding current accounts, and a final account cannot be approved without the clerk's receipt for final court costs, proof that taxes and fees have been paid, and the clerk's certificate on the status of claims.

A final account cannot be approved without the clerk's receipt for final court costs, proof that taxes and fees have been paid, and the clerk's certificate on the status of claims.
Rule 8.11 requires a written petition or statement before a fee in a decedent's estate may be allowed, unless all interested parties appear and agree. The statement must briefly support the fee, including the estate value for tax purposes, services and hours, hourly rate, fee requested and costs advanced.
