Before you begin — know the assets and liabilities
Before you call for a New Castle County appointment, make a working list of what the decedent owned and owed. The value of personal property held in the decedent's name alone decides whether a small estate affidavit under 12 Del. C. § 2306 may be enough, which granting-letters bracket applies under 12 Del. C. § 2510, and how much the percentage closing cost and technology cost may be when the estate closes.
The New Castle County Register of Wills publishes an Information Checklist for gathering identification, accounts, insurance, debts, agreements and utilities after a death, and its free Wills Search can show whether an estate has already been opened. Which court handles jurisdiction
One office serves all of New Castle County: the New Castle County Register of Wills Office in Wilmington. That includes Wilmington, Newark, Middletown, Bear, Glasgow, Hockessin, Claymont, New Castle, Pike Creek, Elsmere, Newport, Delaware City, Odessa, Townsend and Greenville. New Castle is also a city in the county, but the probate filing counter is in Wilmington.
A Delaware will is proved before the Register of Wills of the county in which the testator was domiciled at the time of death (12 Del. C. § 1302(a)), and letters of administration are granted by the Register of Wills of the county in which the decedent was domiciled (12 Del. C. § 1504(a)). If the decedent lived in New Castle County, open the estate in Wilmington even if the personal representative lives elsewhere.
Delaware real estate can create filings in more than one county. A Wilmington decedent who owned a Sussex County beach house still opens the estate in New Castle County, but a copy of the inventory and appraisal must be filed where the real estate is located under 12 Del. C. § 1905, and the affidavit that no Delaware estate tax return is required must be filed where the real property is located under 12 Del. C. § 2304.
The jurisdiction process
- Deliver the original will. Anyone holding a document that may be a will must deliver it to the Register of Wills within 10 days after learning of the death (12 Del. C. § 1301(a)). New Castle County says the original will, not a copy, should be filed even if the decedent had no assets.
- Decide whether a full estate must be opened. New Castle County says an estate must be opened if the decedent had more than $50,000 in personal property in the decedent's name alone, or owned Delaware real estate in the decedent's name alone, either solely or as a tenant in common. A small estate affidavit under 12 Del. C. § 2306 may be available at $50,000 or less for a death on or after June 10, 2026, or $30,000 or less for a death before June 10, 2026.
- Gather the opening forms. The office publishes a Probate Opening Checklist, Case Information Worksheet, Opening Petition Form with a sample, Probate Instructions, Renunciation form, Power of Attorney form for an out-of-state personal representative, and Trust Inquiry Form for estates with a will.
- Call for an opening appointment. An appointment is necessary to open an estate with the New Castle County Register of Wills. Call (302) 395-7800 and ask what to bring. The office also offers appointment-only evening sessions at the Appoquinimink Public Library in Middletown and the Hockessin Public Library, but it does not state that full estate openings can be completed there.
- Attend the appointment and pay the opening fees. Under the New Castle County fee schedule retrieved September 1, 2026, filing the petition costs $5 per personal representative, registering the order and decree admitting the will to probate is $2, and granting letters starts at $25 where personal property is under $50,000, with higher brackets based on value (12 Del. C. § 2510). Bring payment with you.
- Take the oath and order short certificates. The Register grants letters testamentary where there is a will under 12 Del. C. § 1502, or letters of administration where there is not under 12 Del. C. § 1504. The personal representative takes an oath under 12 Del. C. § 1509, and the office issues short certificates, the certified proofs of the letters that banks, brokers, transfer agents, the Division of Motor Vehicles and DNREC accept. New Castle County charges $5 each under its fee schedule retrieved September 1, 2026.
- Handle the Register's Order and publication. The Register posts notice of the grant of letters and publishes it in an approved New Castle County newspaper within 40 days, three times, once a week for 3 successive weeks (12 Del. C. § 2101). The Register's Order fee is $7 under the fee schedule retrieved September 1, 2026. The office's June 13, 2025 newspaper audit priced a three-week estate notice at $25.25 in The (New Castle) Weekly, $120 in the Newark Post and $414.70 in the News Journal or Delaware Online. If the Register determines that the gross personal estate does not exceed $30,000 and the gross real and personal estate does not exceed $35,000, notice may be posted only under 12 Del. C. § 2101(b).
- File the inventory. The inventory and appraisal is due three months from the grant of letters under 12 Del. C. § 1905. New Castle County charges $15 plus $1 per extra page under its fee schedule retrieved September 1, 2026, and requires the inventory to be notarized before filing. Delaware parcels must be listed by parcel identification number.
- Administer claims and watch the estate record. Claims against the estate are barred unless presented within eight months of the date of death under 12 Del. C. § 2102. A creditor can file New Castle County Statement of Claims Form NC.4 for a $20 fee under the fee schedule retrieved September 1, 2026; the claim is presented under 12 Del. C. § 2104, in the form Court of Chancery Rule 191 prescribes. The county Wills Search shows the estate's inventory due date, accounting due date and whether each has been filed.
- File the accounting. An accounting is due within a year of opening under 12 Del. C. § 2301. New Castle County charges $20 per account to record and index it under the fee schedule retrieved September 1, 2026. The office requires receipts for expenses, plus NC5 List of Beneficiaries and NC2 Beneficiary Waivers, or NC3 where a beneficiary is incapacitated.
- Close by appointment. The office says a deputy reviews the closing paperwork and calls the personal representative to schedule the closing appointment. The Probate Closing Checklist is on the county forms page. At closing, New Castle County charges a closing cost of 1.75% of the net personal estate plus a technology cost of 0.25%, and a $50 estate closing letter fee, under the fee schedule retrieved September 1, 2026 (12 Del. C. § 2510).
Executor duties
New Castle County adds several practical duties to the statewide estate settlement work. The inventory and appraisal due under 12 Del. C. § 1905 must be notarized before the office will accept it. Accountings under 12 Del. C. § 2301 must include receipts for every expense claimed, and the office expects the NC5 List of Beneficiaries and NC2 Beneficiary Waiver from each beneficiary, with NC3 where a beneficiary is incapacitated.
Use the county Wills Search as a self-check. The office tells personal representatives to look at the inventory and accounting fields for the estate and file the form if a field is blank. Overdue filings can trigger a Rule to Show Cause from the Register, plus a $25 issuance fee, a $25 Register of Wills hearing fee, a $50 per day court appearance fee and a $100 late fee for every 12-month period of delinquency, all under the New Castle County fee schedule retrieved September 1, 2026.
Opening and closing require appointments with the Register of Wills Office. Dropping off paperwork does not. For closing, the assigned deputy reviews the paperwork and calls the personal representative to schedule the appointment.

The local cost that surprises families is the closing charge: New Castle County adds a 0.25% technology cost to the 1.75% closing cost, so 2.00% of the net personal estate is due at the end under the fee schedule retrieved September 1, 2026. Delaware imposes no estate tax on deaths after December 31, 2017, but 12 Del. C. § 2304 still requires the no Delaware estate tax affidavit where the statute calls for it.

Small-estate Alternatives
New Castle County's small estate affidavit under 12 Del. C. § 2306 is handled at the Register of Wills counter, not through a hearing. It is available when the statutory requirements are met and the solely owned personal estate is $50,000 or less for a death on or after June 10, 2026, or $30,000 or less for a death before June 10, 2026. The statutory real-estate bar applies if the decedent owned Delaware real estate solely or as a tenant in common.
No appointment is required for a New Castle County small estate affidavit under 12 Del.
