Before you begin — know the assets and liabilities

Before you choose forms or call the Independence County Clerk, make a working list of the decedent's accounts, debts, real property, vehicles, business interests, and beneficiary designations. That list determines whether the Batesville filing needs a full administration or whether the affidavit for collection of small estate by distributee may fit under A.C.A. § 28-41-101.

Sunset's 2,300-institution asset discovery helps families build that inventory early, so estate settlement decisions are based on assets and liabilities rather than guesswork. Bring the death certificate, the original will if there is one, and your asset list when you contact the county clerk.

Which court handles jurisdiction

Probate for Independence County is filed at the Independence County Courthouse in Batesville, in the probate division of the Independence County Circuit Court. The court sits in Arkansas's Sixteenth Judicial Circuit, which also includes Cleburne, Fulton, Izard, and Stone counties, but an Independence County estate is filed at the Independence County courthouse.

Arkansas venue for probate and administration is usually the county where the decedent lived at death. If the decedent did not live in Arkansas, venue depends on where the greater part in value of Arkansas property is located, where the death occurred, or where a cause of action may be maintained by the personal representative (A.C.A. § 28-40-102). If more than one county starts proceedings, the first-filed proceeding controls while venue is decided, and a case filed in the wrong county can be transferred under A.C.A. § 28-40-102.

The jurisdiction process

  1. Gather the death certificate, the original will if one exists, the names and addresses of heirs and devisees, and a list of assets and debts. Use this information to decide what kind of estate settlement filing is needed.
  2. Check the Arkansas filing deadline. A will may not be admitted and administration may not be granted unless the application is made within five years from the decedent's death, subject to the statutory exceptions (A.C.A. § 28-40-103).
  3. Decide whether the affidavit for collection of small estate by distributee fits. As of August 2026, A.C.A. § 28-41-101 applies only after 45 days have elapsed since death, when the value is $100,000 or less after encumbrances and excluding the homestead and statutory allowances under A.C.A. § 28-39-101, and when no petition for appointment of a personal representative is pending or granted.
  4. If full administration is needed, prepare the Arkansas Judiciary probate petition forms, including the petition for probate of will and appointment of personal representative or the petition for appointment of an administrator, and add the statewide probate cover sheet.
  5. File the packet with the Independence County Clerk's Office at the courthouse in Batesville. The filing fee to open a decedent's estate is $165.00 as of August 2026, made up of $150.00 under A.C.A. § 21-6-403 and $15.00 under A.C.A. § 21-6-416. Ask the clerk how to present a Rule 72 fee-waiver request if payment is a barrier.
  6. If using the small estate affidavit route, file the affidavit with the Independence County Clerk and request certified copies for institutions holding property. The affidavit filing is $25.00 as of August 2026 under A.C.A. § 28-41-101, and certified copies are $5.00 each as of August 2026 under A.C.A. § 28-41-101.
  7. Watch for notice and hearing requirements. A hearing is required if the petition is opposed or a demand for notice has been filed, and the court may set a hearing in other cases (A.C.A. § 28-40-110). Ask the county clerk how the assigned circuit judge handles appearances.
  8. After the court appoints a personal representative, the clerk issues letters testamentary or letters of administration under the court's seal when the required acceptance or bond step is complete (A.C.A. § 28-48-102).
  9. Publish the notice of appointment after letters are granted, serve copies on heirs, devisees, known creditors, and the Department of Human Services when required, and track the creditor period. Claims are barred six months from the first publication if not properly presented (A.C.A. § 28-40-111).
  10. Administer the estate by collecting assets, managing or selling property when authorized, paying allowed debts and taxes, filing required inventory and accounting papers, distributing remaining property, and seeking final discharge from the court.

When to hire an attorney

A probate attorney makes sense in Independence County when the estate includes real property to sell, creditor disputes, a contested will, missing heirs, tax issues, a business, or a family member who may object to the appointment. Counsel is also useful when an out-of-state personal representative needs local filing help or when the family is unsure whether the affidavit under A.C.A. § 28-41-101 is enough. Sunset connects to a vetted attorney.
